Data Protection Notice for Jimdo Dolphin

The following Dolphin Data Protection Notice applies in addition to the Jimdo Privacy Policy of the Jimdo GmbH which can be accessed at any time here: Jimdo Privacy Policy. Should any terms in the Jimdo Privacy Policy contradict this Dolphin Data Protection Notice, then the provisions of the Dolphin Data Protection Notice shall apply in that case.

Usage analysis

In the edit mode of all Dolphin pages, as well as in the normal mode of all Dolphin pages, where the "tracking" function is activated, Jimdo uses various website analysis tools to analyze the general and specific user engagement with their website. Most of the tools used by Jimdo are provided by third party service providers and use standard Internet technologies to aggregate access data, used in the use of the Dolphin services, into pseudonymised usage profiles and analyse them, as well as make them available to Jimdo. As a result, Jimdo collects personal information from Users, as well as statistical, pseudonymized data and reports on how Dolphin services are generally used by Users.

Statistical, pseudonymous data and reports

Via the general analysis of user behavior, Jimdo learns, for example, which contents of the Dolphin services (tips, tools, functions etc.) are particularly popular, at which times the Dolphin services are predominantly used, in which order contents are typically accessed, to which extent Users find Jimdo vis a vis the various search engines and advertisements, what devices and operating systems our Users use and from which countries, regions and cities the Dolphin services are accessed.

Some of Jimdo's service providers sometimes share demographic information with Jimdo in their reports. For example, the analytics service provider, Google may, due to its own data or insights, know in part or judge whether a User is a man or a woman and which age group they are a member of. Of course Jimdo only receives this information in anonymous form.

In order to provide the Jimdo Dolphin services, Jimdo collects detailed information about how the respective User uses the Jimdo products in the editing mode of all Dolphin pages. This can include for example information concerning the type of content the User views or interacts with, information about the functions the User engages with, the tips that have been successfully followed by the User and events that have been completed, whether or not they have been successfully completed, and the time, frequency, and duration of these activities. However, Jimdo does not record when and where on the Dolphin website specific content was created, altered or deleted.

Jimdo and the (Sub)Processors (hereinafter referred to as “External Service”, “Service Provider” or “Processors”) commissioned by Jimdo store and collect this data in a pseudonymised form. Jimdo ensures that when using the website analysis tools a careful selection of the respective Service Provider occurs and that the applicable data protection requirements for the use of the respective Service Provider/ tools are met.

Purpose of Processing

Jimdo uses these findings first and foremost to provide the innovative Dolphin services and technology (legal basis: Art. 6 (1) (b) GDPR). These services also contribute to continuously improving the content, conceptual and technical aspects of the Dolphin services and adapting them to the usage habits, interests and technical equipment of our Users, as well as improving the creation process for the User.

The list at the end of this Privacy Notice provides an overview of the Service Providers/tools used by Jimdo for (among other things) the Usage Analysis. Which concrete tools are used for the usage analysis may depend on which Dolphin services are used by the User.

With a Dolphin site, it is no longer possible to change or remove usage analysis once it has been saved to the site. Upon receipt of a request, Jimdo may, after consulting the User, close the appropriate Jimdo account and remove the offending personal information from public areas as soon as possible, based on account activity and applicable law. The legal right to information, correction or deletion of personal data remains unaffected.

Dolphin Third Party APIs (Application Programming Interface) and external Platforms/Service Providers

  • Facebook API — This enables Jimdo to interact with the Facebook platform if the User wants to select their Facebook page / profile from publicly available search results.
  • Google Places API — This enables Jimdo to interact with the Google Places platform if the User wants to select their Google Places data / profiles. Related content such as photos, etc. are then available to the User on the User's website via the image library.
  • Google Translations API — This enables Jimdo to interact with the Google Translations platform, should the User wish to do so, and to translate certain information provided by the User.
  • Google Vision API — This API enables Jimdo to interact with the Google Vision platform as the User selects and analyzes their images.
  • Instagram API — When the User logs into their Instagram account through the Jimdo website, they authorize Jimdo to retrieve their Instagram information, and Jimdo can then enable the User to select and use their Instagram content on their Jimdo website at their sole discretion.
  • Bing API - This enables Jimdo to interact with the Bing platform if the User wants to select their publicly available data / profiles from Bing. Related content such as photos, etc. are then available to the User on the User's website via the image library.

The User may connect to their relevant external (e.g., social media) profiles through any of the above APIs (hereinafter referred to as External Platforms) during the website creation process or at any time via the Jimdo Images Library.

When connecting social media accounts / APIs / external platforms to the Jimdo website, the User grants Jimdo the right to access his profile data, including all photos, other profile data (e.g. first name, last name (as provided by the User on the relevant Social media platform), the profile picture, related biography, website URL, if specified, as well as Username and external platform URL), as well as the right to make this content available to the User in their image library.

If the User opens the corresponding social media tab in the dashboard (if logged in to the external platform), Jimdo can load the most recent data from the external platform in the User’s browser. However, Jimdo does not keep a copy of this data unless the User saves it to its Jimdo website.

When the User saves or publishes social media content on their website (e.g. a photo), Jimdo makes a copy of the content for the User and stores it in their image library to make sure that content is available and can be delivered via the Jimdo website. This copy is independent of Instagram. If the User wants to delete the content (e.g. a particular image), they must manually delete the content from the image library and/or their published website. Jimdo has no control over the data stored on external platforms, e.g. Facebook, Google, Instagram, etc. nor does it have control over how such data is saved or deleted. If the User wishes to delete data from an external platform, they must directly contact this platform and/or consult the relevant privacy policy (which is linked in the table below) of the respective platform.

In general, Jimdo saves the User's general profile data from the external platform until the User disconnects from the corresponding external platform via the Jimdo image library/dashboard and correspondingly logs off directly from the external platform in the same browser.

The transmission of the collected data from the User's User account on the external platform to the Jimdo site is exclusively based on the consent of the Jimdo User (Art. 6 (1) a) GDPR), which the User can revoke at any time for the future via the link "Connection Disconnect "in the image library of their Jimdo Dashboard.

Surveys

For the creation and evaluation of online surveys, Jimdo engages the services of various survey providers. The respective privacy policy and contact options of these survey providers can be found in the tabular list at the end of this Privacy Policy. The results of the surveys are used in-house for analysis and as a basis for improving our service offering. In some cases, Jimdo reserves the right to pass on the data provided by the customer to our service providers in order to clarify the facts.

Survey participants can contact Jimdo (privacy@jimdo.com) and ask them to delete their survey data, including personal data at any time. Subsequent correction of individual answers after submitting the survey is not possible.

The Jimdo-appointed external provider/Processor will use this information on behalf of Jimdo to create reports that allow Jimdo to analyze User satisfaction. Furthermore, the external provider can optimize their own services through the use of the online survey by the survey participant and creating data trends. For this purpose, cookies, usage data, device and browser data, log data and possibly data on third-party integrations are recorded. In this case, pseudonymous User profiles of the processed data can be created. In addition, contact information of the Survey Participant can be used to clarify a concern, provided that person has contacted the external provider.
